These Terms and Conditions (“T&C”) govern access to and use of the Examengo platform, available at app.examengo.com, published by NOUR.AI Inc., a corporation incorporated under the Canada Business Corporations Act (CBCA), with its registered office in Canada.

By accessing the platform or creating an account, you agree to these T&C in their entirety.


1. Definitions

  • Examengo: the online examination platform published by NOUR.AI Inc.
  • Instructor: any individual or organisation that creates an account to design, administer, and grade examinations.
  • Candidate: any person invited to take an examination via the platform, whether or not they hold an account.
  • Credit: a unit of value purchased by the Instructor and consumed to activate exams, invite candidates, or use advanced features.
  • Content: the exams, questions, files, and data created or imported by the Instructor on the platform.

2. Description of the Service

Examengo is a SaaS (Software as a Service) platform enabling Instructors to:

  • Create exams composed of various question types (MCQ, code, file upload, free text, etc.)
  • Invite Candidates without requiring prior registration
  • Administer online exams with monitoring and automatic or manual grading
  • Track results and generate reports

The service is provided on a prepaid credit model. Access to certain features requires spending credits.


3. Registration and Account

Registration is reserved for Instructors. To create an account, you must:

  • Provide a valid email address and a secure password
  • Be at least 18 years old, or act on behalf of an authorised organisation (this requirement applies to Instructors only; Candidates, including minors, may take exams without creating an account)
  • Accept these T&C, including the obligations regarding Content (section 7.3)

By ticking the acceptance box when creating your account, you expressly acknowledge that you are solely responsible for the Content you create or import on the platform, and certify that such Content respects the intellectual property rights of third parties.

You are solely responsible for the confidentiality of your credentials and for all actions taken from your account. You agree to notify Examengo immediately of any unauthorised access to your account.


4. Credits and Payments

4.1 Purchasing Credits

Credits are purchased in advance via our payment processor Stripe. Prices are denominated in Canadian dollars (CAD) and displayed inclusive of any applicable taxes.

4.2 Using Credits

Credits are consumed based on actions performed (activating an exam, inviting candidates, using AI features, granting extra attempts, etc.). A detailed breakdown of credit usage is available in your dashboard.

4.3 Non-Refundability

Purchased credits are final and non-refundable, except as required by applicable law. Unused credits do not expire, except upon account closure.

4.4 Complimentary Credits

A number of credits may be granted free of charge upon registration on a promotional basis. Such complimentary credits may be subject to specific conditions communicated at the time of attribution.

4.5 Payment Data

Examengo does not store any banking data. All payment processing is handled entirely by Stripe Inc., whose terms are available at stripe.com.


5. Acceptable Use

5.1 What You May Do

  • Create exams for legitimate assessment purposes (training, recruitment, certification, education)
  • Invite Candidates in the context of your professional or educational activities
  • Use results in the context of hiring, admission, or validation decisions

5.2 What Is Prohibited

The following are strictly prohibited:

  • Creating exams with illegal, discriminatory, hateful, or third-party-infringing content
  • Impersonating a Candidate or facilitating cheating
  • Collecting Candidates’ personal data for purposes other than assessment
  • Circumventing the platform’s security or monitoring mechanisms
  • Reselling, sub-licensing, or commercially exploiting access to the platform without written authorisation
  • Scraping, reverse engineering, or automated data extraction

6. Instructor Responsibility Regarding Candidates

The Instructor is solely responsible for:

  • The content of their exams and its compliance with applicable laws
  • Compliance with PIPEDA, Quebec’s Act respecting the protection of personal information in the private sector (Law 25), or any other applicable data protection legislation concerning Candidates’ personal data
  • Informing Candidates in advance about the collection and use of their data
  • Decisions made on the basis of results obtained via Examengo

Examengo is not liable for the consequences (hiring, admission, exclusion, etc.) arising from the use of exam results.


7. Intellectual Property

7.1 Instructor Content

The Instructor retains full intellectual property ownership of the Content they create on the platform. They grant Examengo a limited, non-exclusive, non-transferable licence to host, display, and process such Content solely for the purpose of providing the service.

7.2 The Examengo Platform

The platform, its code, design, algorithms, and trademarks are the exclusive property of NOUR.AI Inc. Any unauthorised reproduction or use is prohibited.

The Instructor is solely responsible for ensuring that the Content they create or import on the platform — including questions, texts, images, excerpts, or any other material — respects the intellectual property rights of third parties, including copyrights, registered trademarks, and patents.

Examengo does not verify, moderate, or validate Content created by Instructors prior to publication. Examengo cannot be held liable for any copyright or intellectual property infringement committed by an Instructor in the course of creating their exams — for example, using questions taken from a protected textbook without the publisher’s authorisation.

By ticking the acceptance box for these T&C when creating your account, you certify that:

  • The Content you create or import is either original or used with the necessary licences, permissions, or rights;
  • You are solely responsible for any claim, legal proceeding, or damages arising from the unauthorised use of Content belonging to third parties.

Examengo reserves the right to remove any Content reported as infringing third-party rights, without notice or credit refund.


8. Service Availability

Examengo undertakes to provide the service with the reasonable care of a professional SaaS provider. However, the platform is provided “as is” and we do not guarantee uninterrupted availability, including during planned maintenance or unforeseeable events.

During beta or early access phases, service interruptions and changes may occur without prior notice.


9. Limitation of Liability

To the extent permitted by applicable Canadian law, NOUR.AI Inc. shall not be liable for:

  • Data loss caused by improper use of the platform
  • Any indirect damages, loss of revenue, or consequential harm
  • Decisions made by the Instructor or any third party based on exam results

NOUR.AI Inc.’s total liability to an Instructor shall not exceed the total amount of credits purchased in the 12 months preceding the event giving rise to the claim.


10. Termination

You may close your account at any time from your dashboard. Unused credits are not refunded.

Examengo reserves the right to suspend or terminate any account in the event of a breach of these T&C, without notice or refund.


11. Amendments to the T&C

Examengo may amend these T&C at any time. In the event of a material change, users will be notified by email or via the platform at least 15 days before the new terms take effect. Continued use of the service after that date constitutes acceptance of the updated T&C.


12. Governing Law and Dispute Resolution

These T&C are governed by Canadian law, including the Canada Business Corporations Act, PIPEDA, and where applicable, Quebec’s Act respecting the protection of personal information in the private sector (Law 25).

Any dispute shall be subject to the exclusive jurisdiction of the competent courts of Canada.
